By subscribing to FlowCert, provided by ST3 Consulting LLC (“ST3 Consulting,” “we,” “us,” or “our”), you (“Subscriber,” “you,” or “your”) agree to the following terms and conditions:

1. Service Description: FlowCert is a subscription service that provides automated scheduling, testing, and reporting for backflow prevention assemblies in Berkeley County, South Carolina, ensuring compliance with SCDHEC and local water purveyor regulations (e.g., City of Goose Creek).

2. Eligibility: FlowCert is available to residential homeowners in Berkeley County, South Carolina, whose water purveyor is compliant with our service parameters.

3. Subscription Fees and Payment:

• Residential subscription fees are $49.99/year for Carnes Crossroads residents (City of Goose Creek water purveyor) and $59.99/year for other Berkeley County locations.
• Fees are subject to change with prior notice.
• Payment is due annually and will be automatically charged to the payment method on file.

4. Scope of Service:

• FlowCert includes annual backflow testing and reporting to the relevant water purveyor.
• FlowCert does not include maintenance, repairs, or replacement of backflow preventers. These services are available separately and are subject to additional fees.
• Subscriber receives a 15% discount on labor costs for maintenance, repair, or replacement services (excluding parts).

5. Subscriber Responsibilities:

• Provide accurate information about your backflow prevention assembly and water system.
• Ensure access to the backflow prevention assembly on the scheduled testing date.
• Maintain the backflow prevention assembly in good working order (separate from FlowCert).

6. Service Limitations:

• FlowCert is currently available exclusively in Berkeley County, South Carolina.
• ST3 Consulting is not responsible for damages resulting from pre-existing conditions or failures of the backflow prevention assembly.

7. Cancellation and Termination:

• You may cancel your FlowCert subscription at any time. No refunds will be provided for partial subscription periods.
• ST3 Consulting may terminate your subscription for non-payment, violation of these terms, or other reasonable cause.

8. Disclaimer of Warranty: ST3 Consulting provides FlowCert on an “as is” basis and makes no warranties, express or implied, regarding the service’s reliability or suitability for a particular purpose.

9. Limitation of Liability: ST3 Consulting’s liability for any claim arising out of or relating to FlowCert shall not exceed the amount of subscription fees paid by the Subscriber in the preceding year.

10. Governing Law: These Terms of Service are be governed by and construed in accordance with the laws of the State of South Carolina.
